The Biden Administration’s Open-Borders Policy

  • Under the Biden Administration, more than 9.5 million illegal aliens have been apprehended crossing the border illegally or attempting to enter at a port of entry.
  • At least 3.5 million illegal aliens have been released into the United States since Jan. 2021.
  • There have been more than 1.9 million known “gotaways” who crossed the border illegally and evaded apprehension by Border Patrol.

  • The Biden Administration has abused parole authority, which allows an administration to grant temporary admission (parole) to inadmissible aliens “on a case-by-case basis for “urgent humanitarian reasons” or “significant public benefit.”
  • Over one million illegal aliens have entered the United States through Biden’s parole programs, including:
  • Illegal aliens making appointments through the CBP One App;
  • One for Cuba, Haiti, Nicaragua, Venezuela (CHNV);
  • One for Ukrainians;
  • One for Afghans; and
  • A family reunification program.


  • The Biden Administration has released millions of illegal border crossers into the United States despite federal law requiring that DHS detain illegal aliens through their removal proceedings.

  • On his first day in office, Pres. Biden rescinded many of Pres. Trump’s executive orders aimed at reducing illegal immigration, while issuing new orders that encourage illegal immigration. Biden:
  • Terminated Pres. Trump’s order blocking funding for sanctuary cities and requiring the removal of all illegal aliens and replaced it with an order that prioritizes enforcement actions only for terrorists and violent offenders;
  • Ordered a moratorium on deportations for 100 days (later overturned by a court);
  • Terminated Pres. Trump’s Remain in Mexico program for illegal border crossers;
  • Expanded the DACA amnesty for illegal aliens who entered under the age of 18;
  • Immediately stopped border wall funding and construction; and
  • Reversed Pres. Trump’s order that excluded illegal aliens from the 2020 Census.



  • President Biden has issued a Proclamation on Securing the Border" that purports to use executive authority to deny entry to illegal aliens when illegal crossings surpass 2,500 per day over a seven-day period. Full-scale illegal immigration would resume two weeks after illegal crossings drop to 1,500 per day for seven days. Not only does the Biden Proclamation normalize crisis-level illegal immigration, it will fail to have any significant impact on the border crisis because of its own provisions. The order actually specifically allows massive categories of illegal aliens to continue crossing illegally and being released into the United States, including:
  • Unaccompanied Alien Children (UACs), which will incentivize more child trafficking;
  • Parolees (see the second bullet point above); and
  • Any illegal alien “who is permitted to enter by the Secretary of Homeland Security, acting through a CBP immigration officer, based on the totality of the circumstances” or “due to operational considerations.” In other words, ANY illegal alien. 




  • Also on his first day in office, Pres. Biden sent legislation to the House and Senate called the U.S. Citizenship Act, which would have:
  • Granted amnesty to more than 12 million illegal aliens;
  • Eliminated bars on re-entry for removed illegal aliens, effectively giving amnesty to illegal aliens Pres. Trump had already deported; and
  • Exempted most future illegal aliens from deportation.
